The case is not novel, and my sense is that the defense is generally recognized: Just as what would otherwise be the crime of murder, attempted murder, battery, and the like might be justified if done in defense against an imminent threat, so a felon’s taking possession of a gun is justified if done in defense against an imminent threat. (The defense does not apply to a felon’s arming himself against a possible threat of attack at some indefinite future time.) Still, the case struck me as an interesting illustration. "He had to know that he was targeting me," she says. It isn't clear what Ms. Sherrod intends to sue Breitbart for; some variety of defamation, presumably. It seems inconceivable that she could survive summary judgment under the actual malice standard that would apply. Offhand, I would think that she would be better served to sue Tom Vilsack. ]]></description>

Also: &ldquo;In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance&#8230;</p>

Yeah, right. So the guy doesn't want to do what's necessary to actually stop illegal immigration, but he wants to make sure that the children born to all the illegals he helps bring here become U.S.-born illegal aliens?...]]></description>

John Taylor was quoted in the article as sounding skeptical of the paper's findings. He's now had a chance to take a closer look. Seems like he was right to be skeptical . ]]></description>

As you might expect, Ed Schultz and I don't see eye to eye on this subject; he sees nothing wrong with politicizing the banking sector as long as it's his guys doing the politicizing. At the end of the segment, he asked what I would do instead to help small business. I told him it might be a good idea not to raise their taxes. Well, that did it: Ed talked over the rest of my spiel, drowning out the part where I pointed out that raising taxes on the top two tax brackets would hit over 70 percent of small-business profits.
