Initial Observations On Cain’s Mess

In no particular order: TPM, and a lot of others, has been reporting for the last few weeks on how Herman Cain doesn’t have any kind of campaign apparatus in the traditional sense. Boy, does that show now. You would expect past sexual harassment allegations to get a thorough vetting from within the campaign very early on in the process, by which I mean the campaign would do its own due diligence and, if not figure out the underlying facts, at least determine the scope of what is known and unknown, knowable and unknowable, and have a plan for how to respond when the time came. Occupy Protesters Disrupt Catholic Mass in Vancouver (Video)

A group of Occupy Vancouver protesters marched to the steps of Holy Rosary Cathedral to disrupt the Sunday mass service yesterday. The group had planned on disrupting the Sunday services but police officers prevented them from entering the cathedral during mass. CTVBC reported: A group calling themselves “Occupy the Vatican” disrupted service at a downtown Vancouver church Sunday, demanding justice for residential school survivors. The Almanac for American Politics says, “he is a conservative on fiscal issues but more moderate on cultural issues.” The Almanac doesn’t know what it’s talking about. He is certainly bad on a host of cultural issues in his support for using federal funds to clone humans, conduct stem cell research that destroys human embryos, and subsidize Planned Parenthood. Cain Allegations: No There There

In light of last night’s Politico story about allegations against Herman Cain, it is important to clarify the legal meaning of the term “sexual harassment.” Specifically, Politico reports allegations that Herman Cain made an “an unwanted sexual advance” and engaged in “innuendo or personal questions of a sexually suggestive nature.” Politico suggests that this amounts to sexual harassment, using the term at least six times. The truth is that the reported allegations, even if true, do not constitute sexual harassment under the law unless – as the Supreme Court has stated – they are “sufficiently severe or pervasive” to “create an abusive working environment,” among other requirements.
