Yeah, the former Democratic Speaker of the House went there… In fairness, Pelosi’s advisers may have neglected to tell the former speaker that the South Carolina plant was once unionized before employees chose to exercise their rights to become union-free. Her advisers may have also neglected to tell the former speaker that the only reason the Machinists union likely filed charges against Boeing is because those employees chose to exercise their rights to become union free–which would be unlawful retaliation on the part of the union. [Of course, the NLRB seems to be dragging its feet on the union’s retaliation as it may complicate things for the union-run agency–like how the NLRB has allowed itself to become a union pawn and allow its prosecutorial process to become a joke by going after Boeing instead…

He Was Asked To Sing: I didn’t know that. Here’s the context. Okay, that’s kind of different, because even though a Christian hymn is still out-of-place at a press conference, if he was asked to do it by the moderator,…

When Herman Cain talked about what happened after he was accused of sexual harassment while at the National Restaurant Association during his appearance at the National Press Club today, he mentioned that the Human Resources department had been involved in handling the matter. Politico is reporting , however, that the woman who headed up the HR department when Cain was in charge denied last week that she knew anything about the allegations — and wouldn’t discuss the matter today in light of Cain’s statement.

In a previous legal life, I worked as a litigator at a large law firm and on occasion worked (as a defense attorney) for various corporate clients in sexual harassment cases. So I read Politico ’s story with the jaundiced eye of someone who’s represented more than one corporate executive accused of harassment. From what I read, I found the story profoundly underwhelming. Before I go on, let me first make clear that I don’t know the actual facts in the case. I have no idea what Herman Cain did or did not do, and I have no idea whether the events that triggered the complaints have any relevance to his character. I have no idea not simply because I …

Appearing on Saturday's NBC Today, left-wing Washington Post opinion writer and MSNBC contributor Jonathan Capehart dismissed a congressional investigation into the Solyndra debacle as just “the GOP looking to scratch, trying to find a scandal in an administration that is remarkably free of scandal.” After co-host Lester Holt noted that “Republicans have seemed to caught a whiff of scandal” with Solyndra, Capehart argued: “…it's the only program that failed, Solyndra. And also, the other thing to keep in mind is that this is a program that was started – a process that…

(Eugene Volokh) The proposed law would mandate that public and charter schools, city parks, city libraries, and the University of District Columbia ban any gesture or written, verbal or physical act, including electronic communication, that is reasonably perceived as being motivated either by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory handicap, or by any other distinguishing characteristic that: … has the effect of insulting or demeaning any student or group of students in such a way as to cause substantial disruption in, or substantial interference with, the orderly operation of a school, university, recreation facility, or library. Say, then, that someone puts on an event at a park that “has the…

By far, our largest unfunded liabilities are Social Security and Medicare. According to recent actuarial reports , Medicare faces a $25 trillion liability and Social Security has an unfunded liability of $21 trillion. And those numbers are regarded as low-ball figures, due to their unrealistic accounting for cost-cutting measures. They already represent the largest expenditures of the federal government, with Social Security and Medicare consuming 20.2% and 14.6% of the budget respectively. Those numbers are slated to skyrocket as the retirement population doubles over the next three decades. Hence, any meaningful discussion of balanced budgets must include a plan to fix these two entitlement behemoths – brought to you by previous Democrat presidents. …

(Eugene Volokh) So held the European Court of Human Rights in Altuğ Taner Akçam v. Turkey (Oct. 25, 2011) , a case brought by a professor who had been subject to prosecutions (brought by individuals) under the law based on his work on the Armenian genocide. An excerpt from the court’s reasoning: 53. The applicant complained that the existence of Article 301 of the Turkish Criminal Code interfered with his right to freedom of expression. He maintained that the mere fact that an investigation could potentially be brought against him under this provision for his scholarly work on the Armenian issue caused him great stress, apprehension …

CBS's Early Show on Monday found yet another excuse to report on Occupy Wall Street, spotlighting the diehard protesters who stayed in Zuccotti Park during a winter storm. While correspondent Debbye Turner Bell noted the $3.4 million spent on police overtime in New York City and the complaints from businesses near the demonstrators' campsite, she didn't play one sound bite from the opposition. Turner Bell first highlighted the ” freezing temperatures and record-breaking October snow ” over the past weekend in the Northeast and added, “And that does raise the question of how committed are these Occupy Wall Street protesters? But there's another question: can local city governments afford to pay the price tag that goes along with expressing this basic American right? ” Seven out of eight of…

(Eugene Volokh) What does “concedes and dismisses accusations” mean to you? My sense is that in this context “ concedes ” usually means, “acknowledge[s] as true, just, or proper; admit[s].” That’s an uneasy fit with “dismisses,” but I would think many readers would interpret “dismisses” in light of “concedes,” so the phrase means “acknowledges the accusations as true, but dismisses their significance.” Because of this, I was surprised to see the New York Times politics page headline reading, “Cain Concedes and Dismisses Accusations of Harassment”; as the text below the headline noted, Cain claimed he was innocent, which isn’t really compatible…

The deadline for submitting applications for candidacy in Egypt’s upcoming parliamentary elections has now passed, and the shape of the coming competition is coming into focus. On October 21, the Muslim Brotherhood’s Freedom and Justice Party, as a member of the Democratic Alliance coalition, announced the coalition’s lists of candidates in 20 of 27 governates. (After numerous defections, today the Alliance includes few parties other than the Brotherhood.) The published names include only those candidates running for the proportional-representation seats and not individual seats. Under current electoral law, in one third

We all know that Herman Cain is strongly denying the sexual harassment charges written up in the Politico story. And he has said that he was falsely accused while at the National Restaurant Association. But there’s a sentence in the Politico story that I wanted to point out to everyone. It makes no sense at all: “There were also descriptions of physical gestures that were not overtly sexual but that made women who experienced or witnessed them uncomfortable and that they regarded as improper in a professional relationship.” Keep reading this post . . .

A fully accredited college education for the price of a Honda Civic. College? Don’t pay $50,000 for three years, and then your kid drops out. College? Pay for your child’s education, not four years of party time. Wal-Mart University: Save Money. Learn Better. – Gary North. America has an increasingly bad problem with its University system. It costs too much to attend, and the graduates leave with ridiculous piles of debt. Both President Obama and Texas Governor, Rick Perry have outlined proposals to fix the problem. President Obama has proposed a meaningless waste of money to look good in front of the cameras. Rick Perry has proposed something crazier than an outhouse rat. He…

Governor Perry has taken a lot of heat for his opinions on immigration. He supports giving to children of illegal immigrants the same educational benefits Texas gives to other state residents. Perry is right — we should not punish the children for the decisions of their parents. And he is right about the economics: Immigrants do not steal jobs from citizens. That assumption has a superficial appeal: If more people are looking for jobs, there must be more unemployment, all things being equal. Similarly, if I spit

**Written by Doug Powers The pessimist sees this as taxpayers being out $43 million, but the optimistic green bureaucrat will compare this to Solyndra and tout it as saving taxpayers $492 million. The latest DoE loan recipient to declare bankruptcy is Beacon Power Corp : A Massachusetts company that received a $43 million Energy Department loan guarantee last year filed for bankruptcy Sunday, a step certain to fuel criticism of federal green energy financing in the wake of the solar company Solyndra’s collapse. Beacon Power Corp., which develops energy storage systems, filed for bankruptcy protection in the U.S. Bankruptcy Court in Delaware. Beacon Power had received federal loan guarantee …
